In offering expert testimony in civil lawsuits, the forensic economist will want to be aware of different standards of proof when retained on behalf of the plaintiff or the defendant. This paper presents a relevant decision on the subject and then reviews the standards of probability, possibility, and reasonable certainty and their application to forensic economic opinions on causation, damages in fact, and damages measurement.
